Official Sweepstakes Rules

  • NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
  • OPEN ONLY TO ELIGIBLE LEGAL RESIDENTS OF THE 50 UNITED STATES AND DISTRICT OF COLUMBIA WHO, AS OF THE TIME OF ENTRY, ARE AT LEAST 18 YEARS OLD.
  • VOID IN PUERTO RICO AND ALL JURISDICTIONS OTHER THAN THOSE STATED ABOVE AND WHERE PROHIBITED OR RESTRICTED BY LAW.

1. Eligibility

Concordia’s Public Facebook Page New Year, New School Supplies Giveaway (the “Sweepstakes”) is open only to individuals who (i) are eighteen (18) years of age or older at the time of entry and (ii) are legal residents of the fifty (50) United States or the District of Columbia. Void in Puerto Rico and all jurisdictions other than those stated above and where prohibited or restricted by law. The following individuals are not eligible to enter or win a prize: employees, officers, directors, agents and representatives of Creative Communication Associates (“Sponsor”), Concordia University-Portland (“CUP”), their respective parent, subsidiary, and affiliated companies, any other parties involved in the administration of the Sweepstakes, and each of the immediate family members of such excluded individuals (i.e., spouses, parents, children, siblings and the “steps” of each), and all persons living in the same household of each. By participating in this Sweepstakes, entrants agree to be bound by these official rules (“Official Rules”) and by the decisions of the Sponsor and any administrators selected by Sponsor, which shall be final in all matters relating to the Sweepstakes.

2. Sweepstakes Entry Period

The entry period for the Sweepstakes starts on January 16, 2018 at 10:00 AM EST and ends on January 17, 2018 at 2:00 PM EST (“Entry Period”). Sponsor’s computer is the official timekeeping device for the Sweepstakes.

3. How to Enter

To enter, during the Entry Period, visit the CUP public Facebook group “Concordia Portland - Educator’s Community” webpage at https://www.facebook.com/pg/ConcordiaOnlineEducation/posts/ and comment on the sweepstakes post on that public Facebook group page, answering the question – what's the most innovative thing you have done—or have seen another teacher do—in the classroom? You can obtain a maximum of one (1) entry for this Sweepstakes.

Compliance with the entry requirements will be determined by Sponsor in its sole discretion. Submissions that violate these Official Rules will be disqualified from the Sweepstakes.

In the event of a dispute as to the identity of a winner, Sponsor reserves the right to deem the winner to be the authorized account holder of the Facebook account used to enter. The “authorized account holder” is defined as the natural person to whom the account used to enter on Facebook is assigned by Facebook.

4. Winner Selection and Notification

On or about 2 PM EST on January 17, 2018, ten (10) winners will be randomly selected from among all eligible entries received during the Entry Period. Sponsor will notify the winners via a post on the public Facebook page by 4 PM EST on January 17, 2018. If a winner does not respond to Sponsor’s first attempted notification within seventy-two (72) hours, Sponsor reserves the right to disqualify that winner and select a substitute winner from among all remaining eligible entries.

5. Prizes and Prize Claims

Ten (10) winners will win one (1) $50 Target gift card. Winners will be asked to send a private message with their email address and gift cards will be sent via email. The total ARV of all prizes offered in this Sweepstakes is $500.00.

Odds of winning depend on number of entries received. The winners are subject to verification of eligibility, including verification of age and residency, and winning is contingent upon fulfilling all requirements of these Official Rules. The prizes are non-transferable and cannot be redeemed or exchanged for cash. No prize substitution is permitted, except at the sole discretion of the Sponsor. If a prize is unavailable or cannot be awarded for any reason, Sponsor reserves the right in its sole discretion to substitute a prize of comparable or greater retail value. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth herein to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

The winners are solely responsible for all federal, state, local, or other applicable taxes associated with the acceptance and use of a prize. All costs and expenses associated with prize acceptance and use not specifically provided herein are the responsibility of the winners.

As a condition of receiving a prize, each winner must sign and return any documents requested by Sponsor, including but not limited to, an affidavit of eligibility and publicity/liability release. Failure to sign and return any requested documents by the specified return date may result in disqualification of the winner and the forfeiture of all interest in the prize.

6. Publicity

Except where prohibited by law, by accepting a prize, each winner hereby grants Sponsor, CUP and their respective licensees a perpetual, worldwide, royalty-free, non-exclusive and sub-licensable right and license to use, distribute, and publicly display the winner’s name, school/institutional affiliation and likeness in any way, at any time, in any and all media, including on Facebook and for use in advertising and marketing, without limitation and without any additional approval or consideration.

7. Releases and Limitations of Liability

Except where prohibited, by participating in the Sweepstakes, entrants agree to release and hold harmless Sponsor, CUP, their respective parents, subsidiaries, affiliates, officers, directors, employees agents and representatives (collectively, the “Sweepstakes Parties”) and Facebook from and against any claim or cause of action arising out of participation in the Sweepstakes or the receipt or use of any prize, including, but not limited to, claims arising from: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors or failures related to computers, servers, providers, printers or telephone, cellular networks, or network lines; (c) production errors; (d) errors in the administration of the Sweepstakes or announcements relating to the Sweepstakes or the processing of entries; (e) late, lost, or undeliverable messages or email; or (f) injury or damage to persons or property caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use of any prize. Entrant further agrees that in any cause of action, the Sweepstakes Parties’ liability will be limited to the cost of entering and participating in the Sweepstakes and in no event shall the Sweepstakes Parties be liable for attorney’s fees. If, for any reason, an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another Sweepstakes entry, if it is possible for Sponsor to provide such an entry without extending the Entry Period.

8. General Conditions

In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, the Sponsor may, in its sole discretion, either: (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (b) cancel the Sweepstakes and award the prizes in a random drawing from among all eligible entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion, or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

9. Governing Law

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, the rights and obligations of entrants and winners, and the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of New York without giving effect to any choice of law or conflict of law rules. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.

10. Winner’s List

The names of the winners will be posted on the Concordia Portland – Educator’s Community public group page on or about January 17, 2018. For the names of the winners by postal mail, send your written request with a self-addressed stamped envelope to the Sponsor address below: Attn: Melissa Fiorenza. Requests must be received no later than sixty (60) days after the end of the Entry Period.
